Assault is an intentional physical attack on another which causes harm, is intended to cause harm or an alleged victim is put in a state of fear for his safety. This means that attempting to physically attack someone is also considered an assault.
It is often the case that our clients find themselves in situations in which they have had to defend themselves or another and end up being the person charged. It may be that you have called the police complaining of being assaulted and the outcome is that you are the one charged. You may have a special defence to the charge. It is important that you seek specialist legal advice at the earliest opportunity.
An assault charge can be prosecuted in a Justice of the Peace court for minor offences, more serious or aggravated assaults in the Sheriff Court and the most serious assaults are prosecuted in the High Court of Justiciary.
An aggravated assault is a charge of assault which is made more serious either by the result of injury, severe injury or permanent disfigurement to an alleged victim or by the manner of the assault; for example, the use of a weapon or a racial, sectarian or homophobic motive.
